Important Update: On July 12, 2021, the Court granted Final Approval of the Mercedes Class Action Settlement and the Bosch Class Action Settlement.

Approved Emission Modifications ("AEMs") are available for certain subject vehicles now. Click here to find out whether an AEM is available for your vehicle.

An “Approved Emission Modification” or “AEM” is an emission control system modification approved by the U.S. Environmental Protection Agency and the California Air Resources Board that must be installed in Subject Vehicles.

Current Owners and Lessees MUST have an AEM installed before they can file a claim for payment.

Who is included in the Class?

If you purchased or leased and Registered a Subject Vehicle in the United States, you may be a Class Member and eligible for a cash payment even if you no longer own or lease the Subject Vehicle.

The Class is composed of all current and former owners or lessees of Subject Vehicles who:

  • On or before September 14, 2020 owned or leased and Registered a Subject Vehicle;

or

  • After September 14, 2020 began owning or leasing and Register a Subject Vehicle for which an AEM has not been installed.

The Class includes automobile dealers and resellers who meet either of the above qualifications for Class membership (including registration of the Subject Vehicle).

HOW CAN I GET A PAYMENT?

 

Current owners and lessees must have an AEM installed to receive the cash payments. Installation of the AEM is available free of charge to you and you will receive an Extended Modification Warranty after the installation.

If you are a current owner or lessee of a Registered Subject Vehicle and have not opted out of the Class, you can receive a payment by (1) having the AEM installed on your vehicle and (2) submitting a Valid Claim by October 1, 2022. Here are the steps to receive a payment:

     
call your preferred authorized dealership 1. Once an AEM for your vehicle is available, contact your preferred authorized dealership to schedule an appointment to have the AEM installed. Authorized Mercedes-Benz dealerships can be found at www.mbusa.com/en/dealers. If you are a Freightliner Sprinter owner, you can check www.freightlinersprinterusa.com/freightliner/shopping-tools/find-a-dealer for authorized dealerships in your area.

You can check whether an AEM is available for your vehicle here. As AEMs for other vehicles become available, owners and lessees of those vehicles will receive another mailed notice. You may continue to monitor this website, register for updates, or call 1-877-313-0170 to find out whether an AEM is available for your vehicle. Registration on this website alone does not constitute a Valid Claim for cash benefits. If you wish to claim a Class Member Payment, you must submit a Valid Claim by the applicable due date, even if you have registered on this website for updates.
     
Bring your vehicle to your appointment for installation of the AEM 2. Bring your vehicle to your appointment for installation of the AEM.  You must complete the AEM installation before you submit a claim.  Make sure to keep your repair order to submit with your claim, as well as receipts for any travel to and from the dealership for the AEM installation.  If your appointment takes three hours or more and you are not offered a loaner vehicle, shuttle, or alternative form of transportation, you may be eligible to receive reimbursement up to $35 for travel expenses.

If you are a former owner or lessee of a Registered Subject Vehicle, the deadline to submit a Valid Claim was July 12, 2021, and has passed.

YOUR LEGAL RIGHTS AND OPTIONS

DESCRIPTION
DO NOTHING If you do nothing, you will get no payment, stay in the Class and give up your rights to sue the Mercedes Defendants and Bosch Defendants regarding any of the claims in this case. You are still eligible to receive the AEM and the Extended Modification Warranty, as discussed in FAQ 2.
SUBMIT A CLAIM FORM If you are a current owner or lessee of a Registered Subject Vehicle, you will receive a payment if the AEM is installed and you submit a Valid Claim by October 1, 2022.

If you are a former owner or lessee of a Registered Subject Vehicle, you will receive a payment if you submitted a Valid Claim by the deadline of July 12, 2021

To receive payments under both Class Action Settlements, you must not have “opted out” of the Class.

EXCLUDE YOURSELF FROM THE CLASS
This deadline has passed.
Class Members who excluded themselves - or “opted out” - from the Settlement will receive no payment under the Class Action Settlements, but will keep the right to sue the Mercedes Defendants and the Bosch Defendants about the claims in this case. Class Members who excluded themselves from the Class can still receive the AEM and the Extended Modification Warranty discussed in  FAQ 2, but cannot receive any Class Member Payments (see FAQ 29).
OBJECT TO THE CLASS ACTION SETTLEMENTS
This deadline has passed.
Class Members could have written to the Court to object to the Settlement and explain why they did not like the Settlement. (see FAQ 30).

The Court held the Fairness Hearing on July 12, 2021 and issued an Order granting Final Approval of the Class Action Settlements.
